SKY express “My Profile” - Terms of Use
- Scope and Acceptance. These Terms of Use govern access to and use of the “My Profile” online platform (“My Profile”) provided by SKY express S.A. (“SKY express”). By completing the registration process and accepting these Terms of Use, the user confirms that they have read and understood these Terms and agree to be bound by them. These Terms of Use apply exclusively to My Profile and do not replace or supersede the terms and conditions applicable to bookings and the carriage of passengers by air.
- Registration and Use of My Profile. To create and use a My Profile account, the user must enter accurate and up-to-date information in the required fields and keep their access credentials confidential. SKY express may implement appropriate verification and security measures to protect the user’s account and information. If the user wishes to amend their details, they may use the relevant options available within My Profile or contact SKY express Customer Service at customercare@skyexpress.com.
- Available Features. Through My Profile, and subject to the features available within the online application, the user may (a) enter and manage their personal details, (b) benefit from simplified entry of their details when making bookings directly through the official SKY express website and use the available booking management features (“Manage My Booking”), (c) access eligible bookings made directly through the SKY express website, as well as the corresponding booking history for the preceding six (6) months, provided that the relevant information is available and can be securely associated with the user, (d) verify the details of eligible vouchers and their available balances, and (e) receive relevant travel information and updates, in accordance with their communication preferences and applicable law. For information concerning bookings made more than six (6) months previously, the user may contact customercare@skyexpress.com or privacy@skyexpress.com, depending on the nature of their request and in accordance with the applicable procedures and SKY express’s Personal Data Protection Policy. The display of a booking or voucher in My Profile does not amend the terms and conditions applicable to that booking or voucher, nor does it constitute independent confirmation of any entitlement to a refund or other benefit.
- Bookings and Vouchers. Access to booking and voucher information is subject to successful identification or verification in accordance with the relevant My Profile features. The creation or deletion of a My Profile account does not, in itself, result in the creation, amendment or cancellation of a booking, the issuance or redemption of a voucher, or any change to the available balance of a voucher. Any booking change, cancellation, refund or redemption of a voucher is governed by the applicable SKY express terms and conditions.
- Updates and Communications. The user acknowledges and agrees that My Profile is intended, among other things, to facilitate the organisation and management of their travel arrangements by providing useful and, where appropriate, personalised information and updates based on the information they have provided, their bookings and the features available through the service. In this context, SKY express may send updates concerning the operation and security of My Profile, the user’s bookings, the services requested by the user, and information intended to facilitate their air travel. Marketing communications are sent in accordance with applicable law and the user’s recorded preferences. The user may object at any time to the processing of their personal data for direct marketing purposes, in accordance with applicable law, and may request the deletion of their My Profile account at any time. Deletion of the account does not affect the user’s existing bookings.
- Deletion of My Profile. The user may delete their My Profile account using the relevant feature available within the service or by contacting SKY express at customercare@skyexpress.com. Deletion of My Profile does not affect the user’s existing bookings and does not automatically result in the deletion of personal data that SKY express is required or entitled to retain for other lawful purposes, in accordance with SKY express’s applicable Personal Data Protection Policy.
- Personal Data Protection. SKY express processes personal data associated with My Profile in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”), applicable legislation and its Personal Data Protection Policy. Such personal data may include identification and contact details, booking and travel information, voucher details and travel preferences. Personal data are processed for specified purposes and on the applicable legal basis in each case. Acceptance of these Terms of Use does not, in itself, constitute consent to direct marketing or to any optional processing of personal data.
- Security, Availability and Access Restrictions. The unauthorized use of automated means to access, collect or extract data from My Profile, as well as the unauthorized copying or modification of the application, is prohibited. The user must use My Profile responsibly, lawfully and in accordance with its intended purpose, must not permit third parties to access their account, and must not attempt to gain unauthorized access to any third party’s account, bookings or information. SKY express takes reasonable measures to safeguard the security and proper functioning of My Profile but does not guarantee uninterrupted availability. SKY express reserves the right to modify, upgrade, temporarily suspend or permanently discontinue all or any part of the features of My Profile where considered necessary or appropriate for technical, operational, security or maintenance reasons, or for other legitimate business reasons, subject to applicable law. If any fee is introduced for the use of My Profile or for specific features or services, SKY express will provide the user with clear prior information regarding the nature, amount and terms of such fee before it becomes applicable. The proper functioning of My Profile may depend on the availability of an internet connection, whether through Wi-Fi or a mobile network, as well as on the technical capabilities of the user’s device and internet service provider. To the extent permitted by applicable law, SKY express shall not be liable for any inability to access My Profile or any limitation in its functionality resulting from a lack of or interruption to connectivity, exhaustion of the user’s available mobile data allowance, restrictions imposed by the user’s service provider, or other factors beyond SKY express’s reasonable control. SKY express may temporarily restrict access where necessary for security reasons, technical maintenance, the investigation of incidents, or to address any use that violates these Terms of Use or constitutes unlawful use, in accordance with applicable law. Intellectual property rights in My Profile, including its software, trademarks and protected content, belong to SKY express or their respective rights holders.
- Amendments to the Terms of Use. SKY express may amend these Terms of Use, particularly where changes are made to the features available through My Profile, technical requirements or the applicable legal framework. The version in force from time to time will be published on the official SKY express website. Users are encouraged to review these Terms of Use periodically to ensure that they are aware of the version currently in force. Where required by applicable law, users will be given prior notice of any amendments to these Terms of Use or will be required to expressly accept the amended Terms of Use.
- Governing Law and Contact. These Terms of Use are governed by applicable Greek and European Union law, without prejudice to mandatory consumer protection provisions or any other rights conferred by applicable law. For matters relating to My Profile, the user may contact SKY express at customercare@skyexpress.com. For matters concerning the protection of personal data, the user may contact SKY express at privacy@skyexpress.com.
